De-amalgamate Legal Precedent Petition by Goderich Township – Petition of Right of 1628

The Petition of Right of 1628 – to de-amalgamate

Goderich Township

You are invited to Queen’s Park to witness

what has never been done before!

On Thursday, November 27th, MPP Jack MacLaren will present a Petition of Right to the Attorney General, the Honourable Madeleine Meilleur, on behalf of the freeholders of Goderich Township, to de-amalgamate Goderich Township from the Municipality of Central Huron, thereby establishing an historical legal precedent in the Province of Ontario.

The Petition of Right:

  • Became law in 1628, when the Lords of Parliament forced the King to acknowledge habeas corpus and right of rule;
  • Is a common-law right afforded to subjects to redress the Crown for grievances;
  • Is an Imperial Statute, Constitutional Document identified in the Revised Statutes of Ontario 1897; and,
  • Was used successfully in 1986 by Air Canada against the Attorney General in British Columbia in Air Canada v. B.C. (A.G.), [1986] 2 S.C.R. 539

The Petition of Right being pursued in Goderich represents the culmination of several years of hard work seeking to “right a wrong”, and has very important implications for Hope Township residents and Rural Redesign. If you are able to attend on 27Nov2014 please RSVP Jessica Annis as described above. This is a historically significant event and we should all do our best to support this initiative by Goderich.
For those with limited availability, the Question period from 1030 – 1130 during which time MPP Jack MacLaren will rise in the Chamber and present the Goderich Petition of Right to the Attorney General is the most important time for Rural Redesign to attend and demonstrate our support.
For those interested, GO trains leave Oshawa at 0838, 0908, and 0938 and arrive in Union Station at 0941, 1011, and 1041 respectively. From there it’s a short subway ride to Queen’s Park. (Check Google Maps for more detail).
